Is Your Authorization HIPAA Compliant?

Several medical facilities are refusing to send out the patient’s medical records due to the non-compliant authorization. With HIPAA in full effect as of April 2003, there has been a huge delay for adjusters and law offices in receiving their records. Where they once had no problem receiving in the past.

The medical portions of property/casualty coverage such as workers compensation and liability insurance coverage are excluded from the definition of the health plan under the rule. However, there have been numerous requests for records that are being denied due to the non-compliant authorization. Those that are using subpoenas are receiving their records timely.

Several sources now require the use of their own authorization forms to obtain patient records. Since the average source receives hundred of authorizations, the time to review each form for compliance has been time consuming and difficult. In order to make sure you get your medical records in a timely manner contact your copy vendor before requesting records. They should have on record what source requires the use of their own authorization and have a copy in file for you to use.
